
Oklahoma Gun Gifting Laws, What’s Actually Legal
Every year around Christmas, the same question pops up, usually from someone trying to keep a big gift a secret. Can you legally give someone a gun in Oklahoma? Short answer, yes. Longer answer, also yes, but with a few rules you really need to know before you wrap anything up.
The Quick Answer, Yes, But With Rules
Most of us grew up with guns as gifts. A first .22 under the tree. A shotgun for a birthday. It’s a pretty normal thing in Oklahoma, and the tradition still runs deep. But even here, there are lines you can’t cross, and the biggest one is simple, you cannot gift a gun to a prohibited person.
A prohibited person is anyone who legally can’t possess a firearm. If someone falls into one of those buckets, it doesn’t matter how good the sale is or how sentimental the idea sounds, you can’t gift them a firearm. That turns into criminal trouble fast.
There are federal rules about age, too. You have to be 18 to buy a rifle or shotgun, and 21 to buy a handgun from a dealer. But gifting works differently. In Oklahoma, a parent can legally gift a gun to a minor, long gun or handgun, as long as the kid isn’t prohibited. Grandparents, aunts, uncles, whoever... you can also gift a firearm to a minor, but only with the parent or guardian’s permission.

That said, minors can’t just carry a gun around because they were gifted one. Oklahoma limits their use to hunting, sport shooting, training, safety classes, and general supervised recreational use. It has to be for something lawful, not just casual possession.
If you’re trying to gift a gun to someone who lives out of state, that’s where the rules change completely. You can still do it, but the firearm has to be shipped or transferred to an FFL in the recipient’s home state, and they’ll have to pass the background check there. What’s legal in Oklahoma may not be legal in their state at all, so you really want to double-check before you buy anything.
And one last thing, because it’s the big one. Do not, under any circumstance, buy a gun for someone you know can’t buy one themselves. That’s a straw purchase. It’s a federal crime, and the fines and jail time are no joke. If there’s even a little doubt, stop right there and ask an expert.
So yes, gifting a gun in Oklahoma is legal, and a lot of people do it every year. Just make sure the person you’re gifting it to is allowed to own one, follow the rules, and stay on the right side of the law. Santa can get away with a lot, but the rest of us can’t.
